Affiliate Program Terms
Effective date: November 2, 2026 · Version: 2026-11-02
These Affiliate Program Terms ("Affiliate Terms") are an agreement between you and Ember22 LLC, an Illinois limited liability company ("Ember22," "we," "us"), located at 1282 West Northwest Highway, Palatine, IL 60067. They add to our Terms of Service, which still apply to your Ember22 account. Where the two conflict about the Affiliate Program, these Affiliate Terms control.
Who can be an Affiliate
- The Affiliate Program is by invitation. An Ember22 owner invites you; there is no public application yet.
- You must be 18 or older, have an Ember22 account in good standing, and be a United States person able to receive payouts to a US bank account through our payments provider. You do not need a paid plan.
- You accept these Affiliate Terms in the Ember22 app. We record which version you accepted and when.
Your link, your code and the discount
- You get a personal referral link and a personal promotion code.
- Your code gives the people you refer the discount shown in your Affiliate section (by default, 10% off a plan's first payment, or the first year on a yearly plan). The discount applies to plans only. Experience credits are never discounted.
- We may change or end a code's discount for new customers with notice to you. A discount already given is not taken back.
When a customer counts as yours
- A new Ember22 customer (one Ember22 account that pays, called a workspace in the app) is yours if, at its first payment:
- it used your code; or
- the person who paid joined Ember22 through your link within the 90 days before that payment, and no other code was used.
- A code beats a link. If two people could claim a customer, the code used at the first payment decides; otherwise the first link the person used decides.
- This is decided once, at the customer's first payment, and does not change afterwards.
- A customer is never yours if you pay for it yourself, or if you are a member of it.
- Links are tracked in the browser the person uses. A person who switches devices, clears their browser data or blocks storage may not be counted through your link; your code is how to be sure.
What you earn
- You earn a commission on each payment an Ember22 customer that is yours makes for a plan or for Experience credits, for 12 months from its first payment (or the period in your Affiliate section, if we agreed a different one).
- The commission is 20% (or the rate in your Affiliate section) of what the customer paid, less sales tax, after any discount, in US dollars, rounded down to the cent.
- A change to your rate or period applies to payments made after the change. It never changes a commission already earned.
- No commission is earned on a payment made while your Affiliate status is paused or ended, on a payment of $0, or on any amount paid from a customer's account credit.
The hold, refunds and disputes
- Each commission is held for 60 days after the payment before it can be paid out.
- If a payment is refunded, in full or in part, the matching share of its commission is taken back. If a payment is disputed (a chargeback), its commission is held until the dispute ends; if we lose the dispute, the share of the commission on the disputed amount is taken back.
- Amounts taken back are subtracted from what you are owed, including from future payouts if the commission was already paid. If what you are owed is below zero, it carries forward; we will not ask you to pay us back except in a case of fraud.
Payouts
- Payouts are made through our payments provider, Stripe, to an account you set up through Stripe's own onboarding. Stripe, not Ember22, collects your identity, bank and tax details. You must finish that onboarding before you can be paid.
- We run payouts about once a month. We do not promise a fixed date.
- The minimum payout is $50. A balance below $50 rolls over to the next payout.
- Ember22 pays the payments provider's fees for payouts; you receive the full commission.
- You are responsible for your own taxes. Stripe may send you a Form 1099 for the payouts you receive.
- Commissions are paid only after you have accepted the current version of these Affiliate Terms.
What you must do, and must not do
You must:
- Have some form of disclosure to your users that you may earn commission from your affiliate link, as you see fit per the requirements of the US Federal Trade Commission's Endorsement Guides.
- Describe Ember22 truthfully, and only make claims about it that Ember22 itself makes or as you experience it.
You must not:
- Refer yourself, your own business, or an Ember22 customer you are a member of, or open accounts to earn commissions.
- Pay, reward or offer anything to people for signing up or paying, beyond the discount your code already gives.
- Bid on "Ember22," "Ember," or similar terms, or our domain, in search or social advertising, or use them in a domain name, account name or ad that could be mistaken for ours.
- Post your code on coupon, deal or cashback sites, or in places where it can be found by people who never saw your promotion.
- Send spam, or promote Ember22 in any way that breaks the law, our Terms of Service or our Acceptable Use Policy.
- Present yourself as Ember22, or as speaking for Ember22.
Reviews, suspension and ending
- We may review any referral or commission. While a review is open we may hold the commissions it concerns.
- If you break these Affiliate Terms, we may end your participation and cancel commissions that have not been paid. A payout already made is reversed only in a case of fraud.
- You may leave the Affiliate Program at any time by telling us at hello@ember22.com. We may end the Affiliate Program, or your participation, at any time with 30 days' notice. Commissions you earned before the end, and that are not taken back for a refund or dispute, are still paid once they pass their hold and reach the minimum.
Privacy
- To protect our customers, your Affiliate section shows totals only: how many customers you brought, how many are paying, and what you have earned and been paid. It never shows who your customers are, their names, addresses, accounts or payment dates.
- We keep commission and payout records for as long as the law requires, including after your account is closed.
Changes to these Affiliate Terms
We may update these Affiliate Terms. For a material change we will tell you by email or in the app at least 14 days before it takes effect, and ask you to accept the new version. A change never reduces a commission already earned.
Relationship
Nothing in these Affiliate Terms makes you an employee, agent, partner or joint venturer of Ember22, and you may not make commitments on our behalf.
Governing law
These Affiliate Terms are governed by Illinois law, and disputes are handled as our Terms of Service say.
