Terms of Service

Effective date: October 15, 2026

These Terms of Service ("Terms") are an agreement between you and Ember22 LLC, an Illinois limited liability company ("Ember22," "we," "us"), located at 1282 West Northwest Highway, Palatine, IL 60067. They cover your use of ember22.com and the Ember22 web app (the "Service"). By creating an account or using the Service, you agree to these Terms.

What Ember22 does

Ember22 lets you link a video to a printed photo or design. When someone points a phone camera at the print or scans its QR code, the video plays on top of the print in the phone's web browser. No app download is needed. We call each linked print and video an "Experience."

Who can use Ember22

• Account holders and buyers must be 18 or older.
• Ages 13 to 17 may use an account only with permission and supervision of a parent or guardian, who accepts these Terms on their behalf.
• Under 13 may not create an account. Anyone of any age may scan and watch an Experience without an account.

If you use Ember22 for a business, you confirm you have authority to bind that business to these Terms.

Adding a video to someone else's print

Some prints let anyone with a claim code add the video, without an account. If you add a video this way, you accept these Terms and the Acceptable Use Policy for that upload, you confirm you have the rights to it, and you give Ember22 the same license to it as to Your Content.

Your account

Keep your login private. You are responsible for activity on your account. Tell us right away at hello@ember22.com if you think your account was accessed without permission. Business and enterprise accounts may add staff sub-accounts; the main account holder is responsible for all sub-account activity.

Plans, trials and payment

Current plans and prices are listed on our pricing page at ember22.com. We may change prices with at least 30 days notice before your next renewal.

Free trial: 14 days. No payment card is required to start, and nothing is charged when the trial ends. Trial Experiences stop playing after 14 days unless you subscribe, so do not print them for final use. Payment starts only when you choose a plan.

Subscriptions renew automatically until you cancel. Payments and sales tax are processed by Stripe. Refunds are covered in our Refund and Cancellation Policy.

How long Experiences stay live

Paid Experiences stay live for as long as Ember22 operates and your account stays open, including after you cancel your subscription. Cancelling stops you from creating new Experiences, not from playing existing paid ones. Everything is stored in your account, so if you delete your account, your Experiences are deleted too and stop playing. If Ember22 ever shuts down the Service, we will give at least 90 days notice so you can download your content.

Editing Experiences

The QR code for an Experience stays the same. You can replace the video and photo linked to it anytime, free and unlimited.

Your content

You keep ownership of the photos, videos and other content you upload ("Your Content").

You give Ember22 a worldwide, non-exclusive, royalty-free license to host, store, copy, process, compress, display and stream Your Content only as needed to run and improve the Service.

You confirm you own Your Content or have permission to use it, including permission from people who appear in it.

Marketing: we will only feature Your Content in Ember22 marketing if you opt in. Opting in may earn you free credits. You can withdraw permission for future use at any time.

Deleted Experiences are kept for 30 days so mistakes can be undone, then permanently removed.

Businesses and resellers

Businesses may create Experiences for and sell them to their own customers. You are responsible for your customers' content, for having the rights to it, and for your own terms, pricing and support with your customers.

Enterprise and API

Enterprise plans may be covered by a separate written agreement. If that agreement conflicts with these Terms, the separate agreement controls.

Emails

We send account, billing and service emails. Marketing emails and newsletters about new features are sent only if you opt in, and every one includes an unsubscribe link.

Referral and affiliate program

We may offer a referral or affiliate program. Rewards, eligibility and payout rules will be in separate program terms. Affiliates must clearly disclose that they earn a reward when promoting Ember22.

Rules

You must follow our Acceptable Use Policy and Copyright Policy. We may remove content or suspend accounts that break them.

Our property

The Service, software, design, logos and the Ember22 name belong to Ember22 LLC. You may not copy, reverse engineer, resell access to, or build a competing product from the Service except as these Terms allow.

Disclaimers

The Service is provided "as is." Scanning depends on the phone, browser, lighting, internet connection and print quality. We do not guarantee that every print will scan on every device or that the Service will be uninterrupted or error-free.

Limit of liability

To the fullest extent allowed by law, Ember22 is not liable for indirect, incidental, special or consequential damages, lost profits, or lost data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Indemnity

You agree to defend and hold Ember22 harmless from claims arising from Your Content, your customers, or your breach of these Terms.

Ending the agreement

You may cancel any time in your account settings, and you can delete your account yourself in the app or at ember22.com. Deleting your account removes your content after 30 days, and its Experiences stop playing. We may suspend or close accounts that break these Terms or create legal risk.

Governing law and disputes

These Terms are governed by Illinois law. Any dispute will be handled in the state or federal courts located in Cook County, Illinois, and you agree to their jurisdiction.

Changes

We may update these Terms. For material changes we will notify account holders by email or in the app at least 14 days before they take effect.
